These terms govern use of Xulari by a repair shop and its staff. Accepting them requires authority to bind the business.
Your shop's data belongs to your shop. We claim no ownership of it and will not use it for any purpose other than providing and supporting the service. You may export it at any time, in full, without contacting us.
Text messaging is subject to carrier rules and applicable law, including the Telephone Consumer Protection Act. We enforce opt-out handling, quiet hours and frequency limits, and may suspend messaging for an account that generates excessive complaints or attempts to circumvent these controls.
Subscription fees are charged per location, monthly, in advance. Optional add-ons may include a trial period; we will notify you at least twice before a trial converts to a paid subscription, and you may cancel with one click at any time during the trial. Message volume beyond the included allowance is billed as used.
We aim for high availability but do not offer a service level guarantee at this stage of the product. Your shop retains a local encrypted copy of its own data so that it can continue to operate and recover independently of us.
Either party may terminate on thirty days' notice. On termination you have thirty days to export your data, after which it is deleted and the encryption key destroyed. We may suspend an account immediately for non-payment, unlawful use, or abuse of the messaging system.
The Xulari software, its design and its documentation remain our property. Participation as a design partner conveys no ownership of, or licence to, the software.
To the extent permitted by law, our aggregate liability is limited to the fees paid in the twelve months preceding the claim. We are not liable for indirect or consequential loss.
Xulari records what work was done and what was charged. It is not an invoicing, accounting or tax system, does not calculate tax, and is not a substitute for your financial records or professional advice.
