Demo & Free Trial Agreement
Last updated: October 30, 2026
1. Relationship to the Main Terms
This Agreement governs (a) guided or self-serve Demos and (b) Free Trials of the Services. The Xulari Terms & Conditions, Privacy Policy, and Acceptable Use Policy (the "Main Terms") are incorporated by reference. If this Agreement conflicts with the Main Terms on a demo or trial matter, this Agreement controls. Capitalized terms not defined here have the meanings in the Main Terms.
2. Eligibility; Business Use Only
Demos and trials are available only to businesses that operate, or are evaluating software for, an auto repair shop, and to individuals at least 18 years old with authority to bind that business. The Services are offered only for business use, not for personal, family, or household use. We may refuse or end any demo or trial at our discretion, including for competitors or for suspected abuse (for example, creating repeated trials).
3. Limited Evaluation License
During the Demo or Trial Period, Xulari grants you a limited, revocable, non-exclusive, non-transferable, free license for your Authorized Users to use the Services solely to evaluate whether to purchase a subscription for your own shop locations. You may not use a demo or trial for production operations beyond the trial scope, for benchmarking that you publish, or to build a competing product.
4. Demo Environment and Sample Data
Demo accounts contain fictional sample data and may be shared, reset, or wiped at any time without notice. Do not enter real End Customer personal information, ID or insurance details, or payment data into a demo environment. Any data you enter in a demo may be deleted at any time and is not covered by the Main Terms' export rights.
5. Free Trial Period; No Automatic Conversion
5.1 Term. The trial lasts for the period we confirm when it starts or otherwise in writing (the "Trial Period"). We may extend or shorten it with notice.
5.2 No charge. You pay no fees during the trial. We do not collect payment card information to start a trial.
5.3 No automatic conversion. The trial will NOT automatically convert to a paid subscription. A paid subscription starts only when you sign an order form or affirmatively choose a paid plan.
5.4 After the trial. When the Trial Period ends, your account becomes read-only for a limited period so you can view and export your data. Trial data is then deleted unless you subscribe. Subscribing carries your data into your paid account.
6. Trial Data and Live Use
If trials permit real data:
(a) the Shop is the controller and Xulari is the processor, under Main Terms § 32;
(b) the Shop's duties for scans and ID and insurance card details (Main Terms § 8) apply in full;
(c) text messaging to real End Customers during a trial is allowed only after consent capture is configured, and the Shop is the sender of record (Main Terms § 10);
(d) AI Output must be reviewed by a human before use (Main Terms § 9).
7. Pre-Release and Forthcoming Features
Demos and trials may include beta, preview, or forthcoming features, such as job cards, inspections, estimates, invoices, and payments. These may be incomplete, may change or be withdrawn, and are not covered by any support or availability commitment. Payment features are not available in trials unless we say otherwise in writing. Nothing shown in a demo commits Xulari to deliver any feature or meet any timeline. Purchase decisions must not depend on future functionality.
8. Confidentiality
Demos, trial access, non-public features, pricing, and roadmap information are Xulari's confidential information. You will not disclose them, or share screenshots or recordings outside your business, without our written consent.
9. Feedback
You may provide feedback, and we may use it without restriction or compensation (Main Terms § 18).
10. Acceptable Use
The AUP applies. In particular, there is no scraping, reverse engineering, security testing, enumeration of tracker links, or competitive analysis. Do not create multiple trials to extend free access.
11. Disclaimer – As-Is; Accuracy; AI
DEMOS, TRIALS, SAMPLE DATA, AI OUTPUT, AND PRE-RELEASE FEATURES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT SUPPORT, SERVICE-LEVEL, OR UPTIME COMMITMENTS. XULARI DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XULARI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. XULARI'S TOTAL LIABILITY ARISING OUT OF ANY DEMO OR TRIAL WILL NOT EXCEED US $100. THESE LIMITS APPLY TO ALL THEORIES, INCLUDING XULARI'S OWN NEGLIGENCE (SOLE, JOINT, OR CONCURRENT) OR STRICT LIABILITY, EXCEPT FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD.
13. Indemnity (Conspicuous)
YOU WILL DEFEND, INDEMNIFY, AND HOLD HARMLESS THE XULARI PARTIES FROM THIRD-PARTY CLAIMS ARISING FROM YOUR USE OF A DEMO OR TRIAL, INCLUDING ANY REAL DATA OR MESSAGES YOU SUBMIT OR SEND AND ANY VIOLATION OF THIS AGREEMENT, THE MAIN TERMS, OR LAW. THIS INDEMNITY APPLIES EVEN IF THE CLAIM ARISES IN PART FROM THE NEGLIGENCE OF A XULARI PARTY, BUT NOT TO THE EXTENT IT IS FINALLY ADJUDICATED TO RESULT FROM A XULARI PARTY'S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD. The procedure in Main Terms § 24 applies.
14. Termination
Either party may end a demo or trial at any time. We may suspend access immediately for an AUP violation or a security risk. The following survive: Sections 4, 5.4, and 8–16.
15. Disputes; Governing Law
Main Terms §§ 27–28 apply: Texas law, AAA individual arbitration, class and jury waivers, a small-claims carve-out, a 30-day opt-out, and no limitations period shorter than two years. Venue: Harris County, Texas.
16. Miscellaneous
This Agreement, together with the Main Terms, is the entire agreement about demos and trials. We may update it going forward with notice. Updates do not apply to a trial already in progress without your consent. Electronic acceptance is binding.
